$745,000 Hospital Negligence Settlement

The Absent Doctor Case

When we talk about medical malpractice, what usually comes to mind are doctors who make surgical mistakes or physicians who prescribe the wrong medication. But there are many other forms of medical negligence that could constitute a malpractice case. Sometimes, it can be as simple as a doctor not being present when needed.

An example is one case that was brought to us at Kassel McVey. The client’s wife was admitted to a hospital for her abdominal complaints. Soon afterwards, she showed signs of a stroke, including slurred speech, headaches, eye complaints, and weakness on one side. Her attending nurse noticed these symptoms and called the physician to evaluate the patient. Despite the nurse’s repeated calls, the doctor never came.

Fortunately, with our legal representation, our client and his wife were able to obtain a settlement of $745,000.

As this case illustrates, medical negligence can come in less-obvious ways. Some examples are:

  • Disregarding patient history
  • Failing to consider or advise on possible side effects
  • Failing to advise on the risks of a medical procedure
  • Premature discharge from hospital
  • Poor monitoring, aftercare, or follow-up
  • Inadequate hospital staffing
  • Inadequate hospital staff training
  • Negligent hospital staff hiring.

Have you had a similar experience with a physician or healthcare provider? Or do you believe that your doctor has been negligent in some other way? Bear in mind that not all undesirable medical situations are due to malpractice. But if you suspect that some form of negligence did occur, it may be worth it to at least consult a lawyer. The assessment of a medical malpractice attorney is the most reliable way to determine if you have a malpractice case.
